Vote YES on Smith-Amash Amendment to H.R. 4310, National Defense Authorization Act for FY 2013

Representatives Adam Smith (D-WA) and Justin Amash (R-MI) are proposing an amendment to H.R. 4310, the National Defense Authorization Act for Fiscal Year 2013 (“NDAA FY 13”). A floor vote on the amendment is expected this week.

The Smith-Amash amendment erases the stubborn misperception that last year’s NDAA (“NDAA FY 12”) and the Authorization for Use of Military Force (“AUMF”) authorize military detention and trial of persons detained in the United States.

Such domestic military powers violate the Constitution and obliterate limits on Presidential authority crucial to any Republic. Smith-Amash also preserves an appropriate role for State courts in the battle against terrorism.
